What is a Notice of Allowance?

A Notice of Allowance is only issued on trademark applications filed as "Intent-to-Use," also know as Section 1(b).
When a Notice of Allowance is issued on these applications, this is actually great news! It means that your trademark application has passed the review by the Examining Attorney at the USPTO and is being allowed to move forward and is another step closer to registration.
When the USPTO issues a Notice of Allowance on your application you have 6-months from the issue date to file what is known as a Statement of Use, or an Extension of Time. A Statement of Use is you filing and showing proof that you are using your trademark in connection with your listed goods or services within the marketplace. Trademark applications are not allowed to register until they have begun selling all of their goods or services within the marketplace.
